The market registered these contained advances on Saturday October 3 2026. The chart showed steady spot buying in the majors with no sharp reversals in the session. Volume remained measured across the major pairs while perps stayed within narrow bands.

October 2 Filing Details

The Independent Community Bankers of America filed suit against the Office of the Comptroller of the Currency on October 2 2026 in the U.S. District Court for the District of Columbia. The action was brought under the Administrative Procedure Act. It asks the court to declare the March 2 2026 final rule and Interpretive Letter No. 1176 unlawful and to vacate the conditional national trust bank charter granted to Protego Holdings Corp. in February 2026.

President and CEO Rebeca Romero Rainey stated that charters permitting substantial non-fiduciary activities exceed the authority Congress granted to the OCC. She noted that the national trust charter was not intended as a route for firms that bypass Community Reinvestment Act requirements, consolidated supervision, capital standards, liquidity rules, and FDIC insurance.

Scope of the Request

The filing argues that the March 2 2026 rule and the interpretive letter attempt to extend charter powers beyond those authorized by the National Bank Act. That statute limits trust bank charters to entities performing fiduciary activities. National trust banks that do not accept deposits fall outside large portions of federal financial oversight and can preempt many state regulations.

The OCC had never before issued a national bank charter to an institution that neither took deposits nor conducted fiduciary work. The ICBA release states that digital assets held at a crypto firm operating under such a charter lack the federal consumer protections normally associated with a federally chartered bank.

Pending Status

No court order has been issued. The suit seeks to return the OCC to its statutory boundaries and to vacate the February 2026 conditional approval for Protego Holdings Corp. Protego focuses on digital asset custody, trading, lending, and issuance.

The price action on October 3 reflected these regulatory headlines through modest upward candles rather than volatility spikes. Spot markets absorbed the news without significant selling pressure while majors continued their contained advances through the afternoon session.
